By accessing and using the TalentUs platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this Service.

TalentUs is operated by CrudCreativo ("Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of our website and services.

2. Description of Service

TalentUs is a Human Resource Information System (HRIS) that provides:

• Employee management and tracking
• Recruitment and applicant tracking (ATS)
• Payroll processing and management
• Time and attendance tracking
• Benefits administration
• Learning and development management
• Performance management tools
• Reporting and analytics

3. User Accounts

To access certain features of the Service, you must register for an account. When you register:

• You agree to provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as detailed in the Privacy Policy.

You retain ownership of all data you upload to the Service. We do not claim ownership of your data and will not use it for purposes other than providing the Service.

5. Multi-Tenant Architecture

TalentUs operates on a multi-tenant architecture where:

• Each organization's data is logically isolated from other organizations
• Data access is restricted based on your organization's tenant ID
• We implement industry-standard security measures to protect data isolation

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Upload malicious code or attempt to breach system security
• Interfere with or disrupt the Service
• Collect or harvest user data without authorization
• Use the Service for any unlawful purpose

7. Payment Terms

For paid subscriptions:

• Fees are billed in advance on a monthly or annual basis
• All fees are non-refundable unless otherwise stated
• We reserve the right to change pricing with 30 days notice
• Failure to pay may result in service suspension

8. Service Availability

We strive to maintain 99.9% uptime for our Service. However:

• We may perform scheduled maintenance with advance notice
• We are not liable for downtime due to factors beyond our control
• We reserve the right to modify or discontinue features with notice

9. Intellectual Property

The Service and its original content, features, and functionality are owned by CrudCreativo and are protected by international copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, CrudCreativo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses.

11. Indemnification

You agree to indemnify and hold harmless CrudCreativo and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to the Service will be revoked
• You may request export of your data within 30 days
• We will delete your data according to our data retention policy

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Dominican Republic, without regard to its conflict of law provisions.
